
13. Garden structures
All garden buildings and structures are subject to approval under the Scheme of Management even though they may be exempt from planning permission:
Paragraph 3. (a) of the Scheme of Management provides that without the prior written approval of the Managers no material alteration shall be made to the external appearance of any building or structure on an enfranchised property and no new or additional building or structure shall be erected thereon.
The Managers of the Scheme are the Incorporated Trustees of The Dulwich Estate and written approval for alterations is provided to applicants by way of a Licence.
Garden structures include sheds, greenhouses, outbuildings, play structures for children and swimming pools (see separate Guidelines for Swimming Pools). In addition, pergolas, raised decks, terraces and patios are also structures requiring approval.
Prime consideration must be given to the effect of any proposed structure on the amenity of neighbours. If neighbours would be overlooked from raised terraces, decking or patios, it may be necessary to improve privacy by raising the boundary fences and ensuring that screen planting is maintained.
Many gardens are not suitable for tree houses and climbing frames due to the close proximity of neighbouring properties. Children playing above the level of boundary fences can intrude on the privacy of adjoining properties.
Small sheds and greenhouses should be sited in locations that are not conspicuous to neighbours. Screen planting may be required to mask the appearance of these buildings. The roofs of large sheds should be covered with slate, tiles or cedar shingles rather than roofing felt.
Gardens should not be seen as an opportunity for further residential extension; playrooms and garden rooms that can be used to entertain may become the focus of activities that are a nuisance to neighbours.
