
10. Change of Use
Businesses conducted from residential properties
Freeholders of residential property subject to the Scheme of Management do not require approval to conduct 'unobjectionable' business from the property. "Unobjectionable" businesses are those which:
- Have no adverse effect on the visual amenity of the property or on its locality.
- Cause no disturbance of any sort to neighbours of adjoining properties or in the locality.
- Do not cause problems by the parking of commercial and other vehicles by employees and visitors connected with the business. In addition, paragraph 7.of the Scheme of Management provides:
No owner of any enfranchised property shall park or permit or suffer any resident therein or employee or visitor to his property to park any vehicle on any private road on the Estate so as to cause obstruction.
- (Notwithstanding paragraph 6(b)(iii) of the Scheme of Management, which prohibits any inscription, placards, posters, advertisements or notices of any kind from being placed or exhibited on a property so as to be visible beyond its boundaries, without the prior consent of the Managers), affix only a small and discreet sign to the entrance or boundary of the property to advertise the existence of the business.
- Are of a scale and nature which is compatible with predominantly residential use.
Generally, the use of residential properties as hostels, nurseries, crèches, care homes and other commercial activities will require the prior approval of the Managers.
The Managers of the Scheme of Management, the Incorporated Trustees of The Dulwich Estate, retain their right under the Scheme to stop any activity which is consider to be detrimental to the neighbourhood.
Subdivision of residential properties
Proposals to subdivide houses into flats or other self-contained residential units require the prior approval of the Managers of the Scheme of Management (as well as planning consent from the Local Authority). In addition to considering proposals for any alteration of the external appearance of the property, the Managers will also have regard to the effect on the amenity of neighbours and the implications for the residential character of the area and these aspects will generally take precedence.
